1. Acceptance of Terms

By visiting our website or purchasing from Amelia Gallery, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use, as well as our Privacy Policy and Shipping & Returns Policy.

2. Intellectual Property

All artwork, images, logos, text, and digital content on this website are the exclusive property of Amelia Gallery or the respective artists.
You may not reproduce, distribute, modify, or use any content without written permission. Copyright remains with the artist at all times, unless explicitly stated otherwise.

3. Artwork Availability

Original works and limited editions are sold on a first-come, first-served basis.
While we strive to maintain accurate availability, listings may change without notice due to exhibitions, reserves, or sales made offline.

4. Pricing & Payment

All prices are listed in USD.
We reserve the right to modify prices at any time.
Payment must be completed at checkout. Fraudulent or unauthorized payments will result in cancellation of the order.

5. Accuracy of Descriptions

We make every effort to provide accurate descriptions, dimensions, and images of the artworks.
However, colors and textures may vary slightly depending on lighting, the medium, or digital screens. Such variations do not constitute defects.

6. User Conduct

You agree not to:

  • Interfere with the website’s functionality

  • Attempt to access restricted areas or modify content

  • Use the site for fraudulent or unlawful purposes

Violation may result in restriction or termination of access.

7. Limitation of Liability

Amelia Gallery is not responsible for:

  • Delays caused by carriers or customs

  • Damage resulting from incorrect hanging or handling

  • Losses resulting from misuse of the website

Our total liability will not exceed the amount paid for the artwork purchased.

8. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Any disputes shall be resolved in Miami-Dade County, Florida.

Shipping & Returns

1. Shipping Overview

Amelia Gallery ships original artworks and limited-edition prints worldwide.
Shipping costs are calculated at checkout based on:

  • Artwork size

  • Weight

  • Destination

  • Carrier rates (UPS, USPS, DHL, FedEx)

Original paintings require professional packing, insurance, and signature delivery.

2. Processing Time

  • Original artworks: 5–10 business days for professional packing

  • Limited edition prints: 3–7 business days

  • Custom or framed items: 7–14 business days

Processing times may vary during exhibitions or holidays.

3. Packaging & Insurance

All artworks are:

  • Packed using museum-grade materials

  • Insured for the full value during transit

  • Delivered with tracking and signature confirmation

We strongly recommend inspecting the package upon delivery.

4. International Shipping

International buyers are responsible for:

  • Customs duties

  • Import taxes

  • Brokerage fees

Amelia Gallery cannot predict or modify these fees.

5. Damaged Shipments

If your artwork arrives damaged:

  1. Keep all packaging.

  2. Photograph the box, interior materials, and artwork.

  3. Contact us within 48 hours at info@ameliagallery.com.

We will file an insurance claim and arrange repair, replacement, or refund depending on the piece.

6. Returns & Exchanges

Because we handle fine art, all sales are final except in cases of:

  • Damage during shipping

  • Incorrect item received

  • Verified defect in the artwork or print

We do not accept returns due to:

  • Buyer’s remorse

  • Change of preference

  • Minor color or texture variations

Limited edition prints that have been opened, handled, or altered cannot be returned.

7. Cancellations

Orders may be canceled within 24 hours of purchase only if the artwork has not yet shipped.
After 24 hours, cancellations are no longer possible due to insurance and packing procedures.

8. Local Pickup

Buyers located in South Florida may schedule pickup at:
